TERMS AND CONDITIONS 1. The term Company shall refer to A Violin Shop. At the end of the trial period, the customer may rent monthly. Mozart group instruments rent at $24.00 per month plus $3.00 repair/loss protection. Bach Group instruments rent at $38.95 per month plus $3.00 repair/loss protection, plus tax. The instrument is the property of A Violin Shop. You may not sell it or move it to another state. You must notify the Company if you change address or move. 2. You will receive a coupon booklet with the monthly payment and due date listed. Rental payments are due in advance. There are no refunds on rental monies paid. Past due payments and late charges do not apply toward purchase of instrument. A late charge of 11/2% per month (18% per annum) is assessed on late payments. A payment is considered late if not received within 15 days of due date. If 60 days past due, this agreement may be canceled with the unpaid balance due immediately. If an account is turned in for collection, you will be responsible for collection costs. 3. Ownership of the instrument shall remain with the Company until the total rental payments equal the Total Rental Cost. (Plus sales tax for the instrument.) If rental payments are not paid when due the Company shall have the right to take possession of the instrument. 4. The renter retains the right to terminate this agreement at any time by returning the instrument to the Company. If returned, all payments shall be considered rental with the account being brought up to date at the time of return. Renter is responsible for instrument until it is returned to our place of business. Phone A Violin Shop to return instrument. 5. All repairs must be made by the Company. The Company does not provide replacement strings, rosin, bow hair, bridges or other expendables. Nor does the Company restore appearance or refinish scratches that do not affect the instrument’s performance. Repair/Loss Protection means that the instrument will be replaced with a similar one if lost by fire or theft. Loss must be reported to Police or Fire Department within 24 ours after discovery of loss. The replacement instrument will not be covered by loss. Also, deliberate damage or negligence will not be covered. The Company will not cover loss or any repairs if there is an overdue balance. The instrument covered under Repair/Loss will be repaired free of charge against damage or manufacturer’s defect. FREE LOANER when available if repair takes longer than 3 business days. 6. Rental instruments are not always new but will be in good playing condition. 7. Renters are allowed all rental money paid on smaller sized instruments to apply toward the purchase of their new full sized equivalents. The actual price of new full sized instruments cannot be anticipated but "current prices’ are listed below. Your Price will be the "current price" at the time of exchange to a new full sized instrument. Current examples of prices for student models with horse hair bows are: Violin, $900 and up, Viola $1200 and up, and Cello, $1500 and up. CUSTOMER OPTIONS 1. A customer may return an instrument and terminate this agreement at any time providing payments are up to date. 2. A customer may continue monthly payments until agreement is complete. (Based on current prices.) At that time, ownership will be transferred to the customer. 3. Early Purchase Price. Customer may at any time purchase the instrument by taking the total rental price as shown on this agreement, deducting the total of all rental payments made, and then paying the remaining balance minus the early purchase cash discount shown below. Total rental payments do not include late fees, repair/loss coverage or other charges and are based on current prices. 4. Cash discount will be: |
